Between the pickup site and the destination, the carrier and driver may operate and carry their respective motor vehicles both jointly and individually. No assurances can be offered regarding the pickup or delivery date, even though every attempt will be taken to confirm a driver for the anticipated day. Unexpected events like carrier scheduling, mechanical issues, bad weather, and acts of God can all cause delays. Any costs or obligations incurred as a result of a pickup or delivery delay are not the responsibility of Capstone Auto Trans. This includes, but is not limited to, airfare and parking costs. At the moment of dispatch, the customer will get the carrier's schedule. 2. The customer guarantees that they won't work with any other brokers or carriers during the period that corresponds to their shipping choice. Any customer who is discovered dealing with another broker or carrier during this time will be charged a deposit fee that is not recoverable. 3. As long as the truck driver can physically get to the pick-up and delivery destinations, contracted carriers offer door-to-door delivery. The driver may request that you meet the truck at a big parking lot nearby, such as a grocery store, if access to the pickup or delivery spot is impeded by narrow streets, low-hanging trees, or tight curves. 4. Although we do recognize that you might need to load certain stuff into the car, carriers are not authorized or insured for carrying any personal or domestic belongings. If excess items or the wrong personal things are loaded into the vehicle, the carrier is not responsible for the resulting damage. These must be stored in the trunk and maintained under 100 pounds. Any exclusions must first be agreed with Capstone Auto Trans and granted. Personal items of any extra weight may incur an extra charge. Any misrepresentation of personal possessions will result in a pricing modification and/or a $150 dry run fee if a carrier is required to show up at the location of the pick-up and the cargo is not what was anticipated. A further $75.00 rescheduling fee will be charged if a carrier is dispatched and the vehicle is not ready as stated by the shipper. If the shipper cannot be reached for pick-up or delivery, Capstone Auto Trans must be contacted, and the shipper must designate a substitute representative to act in the shipper's place. 5. Vehicles must be presented to the carrier with no more than a half tank of gasoline and in excellent operating condition. Damage brought on by fluid leaks, freezing, exhaust systems, or loose antennas will not be covered by carrier's insurance. At the time of delivery, any claim for loss or damage must be made on the condition report and acknowledged. 6. Carrier coverage for trucking damage claims ranges from $100,000 to $250,000 for cargo insurance per load and at least $750,000 for public liability and property damage. Capstone Auto Trans, is not solely liable for any damage to a vehicle that occurs during transfer. All contracted carriers will be covered by insurance to cover theft or driver-caused damage while being transported. In the event that damage occurs, Capstone Auto Trans will give you a complete insurance paperwork so the shipper may submit a claim. All claims must be made in writing within 15 days of delivery, and they must be acknowledged and signed for at the time of delivery. 7. A further $75.00 rescheduling fee will be charged if a carrier is dispatched and the vehicle is not ready as stated by the shipper. If the shipper cannot be reached for pick-up or delivery, Capstone Auto Trans must be contacted, and the shipper must designate a substitute representative to act in the shipper's place. After an order has been placed, Capstone Auto Trans will not return the deposit if, for any reason, the car is unavailable during the designated pick-up time. 8. Regardless of the time of day or the weather, the customer should never release or accept a vehicle from a carrier without an inspection report (Bill of Lading/BOL). If this isn't done, the customer might not be able to submit a damage claim. Only damage claims brought against the carrier's insurance will be handled. Within 24 hours after delivery, Capstone Auto Trans must be notified of any damage. The driver must properly note any damage on the BOL and sign it. (No exceptions). If there is damage during transit, the client is required to note it on the final inspection report, pay the amount due under this Agreement, and then get in touch with the carrier's head office and insurance provider. Inability to process a damage claim would stem from failure to note any damage on the final inspection report, which absolves the carrier of any responsibility. 9. Orders that have already been dispatched must be canceled by contacting Capstone Auto Trans at 832-521-7224 or info@capstoneautotrans.com. Prior to the pick-up date, cancellations must be made at least 24 hours in advance. Order cancellations that have already been dispatched are subject to a $200 non-refundable charge. 10. All non-running automobiles will incur a $150 non-operational cost. The ultimate price that you will pay to Capstone Auto Trans will reflect this. This price will be added to the initial estimate if the vehicle ceases to function during shipment. 11. Capstone Auto Trans commits to offer a carrier to move your automobile as soon as possible in line with your instructions, but we can't promise a certain time for pick-up or delivery. Order cancellations made seven days or more prior to the desired available pick-up date will incur a $200 cancellation fee. Capstone Auto Trans does not undertake to cover the cost of your car rental, and it disclaims all responsibility for the technical or operational failure of your car. Shipper guarantees that he or she will pay Capstone Auto Trans the amount owed for the delivered automobiles and won't try to get a credit card charge returned. All terms and conditions of the carrier's tariff and the uniform straight bill of lading, copies of which are available at the carrier's office, apply to this agreement and any shipment made in accordance with its provisions. 12. The laws of the State of Texas shall govern this agreement and be followed in its interpretation. The parties further concur that Capstone Auto Trans's 1.liability is restricted to the sum of money equal to the broker's fee alone, and that any legal action arising out of this agreement must be brought in a court with jurisdiction. The client hereby waives any right to jurisdiction in any other venue and submits to the jurisdiction of such courts.By signing here, I accept the transit conditions stipulated by Capstone Auto Trans. I provide permission for a modest down payment to be made to Capstone Auto Trans via phone, mail, credit card, debit card, or cheque.
